Definitions

  • Business Analytiq: Business Analytiq Pte Ltd as incorporated in Singapore
  • Trend Data: The data contained in the Business Analytiq system
  • System: The Business Analytiq online software
  • Authorized User: A company who has been granted permission by Business Analytiq to access the Trend Data and the System. The Authorized user is identified through a unique username.

 

Notes on the Trend Data contained in the System

  • The Trend Data for the current month and recent history are fine-tuned over time and are highly likely to be revised
  • BusinessAnalytiq are continually improving data sources, data collection and processing methods.
  • As a consequences all Trend Data, including historical Trend Data, will be updated from time to time if we believe it leads to a significant improvement on accuracy.
  • By their inherent nature, outlooks are uncertain
  • The Trend Data tracks changes in a particular direction over time.
  • The Trend Data can be used to identify patterns, shifts or fluctuations in a specific metric, such as sales, stock prices, or website traffic, and helps to reveal the underlying trend or direction in which the metric is moving.
  • The Trend Data for a particular product or category is a general trend. It may from month to month contain mix elements. It does not track a single specification unless otherwise indicated
  • BusinessAnalytiq assume no responsibility or liability for any errors or omissions in the Trend Data contained in this site.
  • If BusinessAnalytiq cannot get an accurate estimate of the current month or outlook, that Trend Data will not be updated in any given month
  • The source of the Trend Data are mainly public non-confidential sources.
  • BusinessAnalytiq combine public publications, trade associations, import/export records, company announcements, and various other ad-hoc sources of public information.
  • The Trend Data is collected and stored in local currency and translated into reported currencies using monthly average mid-market FX rates.
  • The Trend Data information is provided on an “as is” basis with no guarantees of completeness, accuracy, usefulness, fitness for purpose or timeliness.

 

Limitations on Liability

  • To the fullest extent permitted by law, Business Analytiq and its directors, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or in connection with the use of the System and Trend Data, including, but not limited to, loss of profits, revenue, data, or other economic advantage, even if Business Analytiq has been advised of the possibility of such damages.
  • BusinessAnalytiq shall not be liable to customer or any other user for any inaccuracy, delay, interruption of service, error or omission regardless of cause in the Trend Data or System.
  • In no event will BusinessAnalytiq be liable to customer, authorized user or any other person for any decision made or action taken in reliance on the Trend Data or the System
  • In no event shall the liability of Business Analytiq and its directors, officers, employees, agents, and affiliates exceed the total amount paid by the customer for the System and Trend Data during the preceding twelve months.
  • This limitation of liability shall apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.

 

Fees & Charges

  • The customer shall pay all fees and charges in United States Dollars plus all applicable taxes, including value-added, sales, use and similar taxes.
  • Access to Trend Data and System will be granted only upon payment confirmation.
  • If customers do not pay, they will lose access, and all work will be deleted

 

Passwords

  • User accounts with access to the System and the Trend Data are for the use of the company to whom they are issued and may not be made available to others outside the company
  • If BusinessAnalytiq suspect that a user account is being used by an unauthorized person, it will disable that account and the work may be deleted

 

Except as expressly permitted in the License Terms or the General terms and conditions, the customer shall not

  • Publish, transmit or otherwise communicate the Trend Data or Derived content to any other person or to the public generally
  • Copy, adapt, modify, reverse engineer or tamper in any way with the System
  • Create internet links to the System or mirror the System on any other server or device
  • Use the System or Trend Data for any unauthorized purpose

 

Availability of System and Trend Data

  • BusinessAnalytiq shall use all reasonable efforts to ensure that the System and Trend Data are available to Authorized Users
  • BusinessAnalytiq will carry out occasional maintenance or upgrade efforts which may temporarily disable access

 

System Changes

  • BusinessAnalytiq may update, enhance, withdraw or otherwise change the System or Trend Data at any time without notice to Customer.
  • Where changes will lead to a material decrease in functionality, BusinessAnalytiq will provide Customer with thirty (30) days’ notice.

 

Intellectual Property Rights

  • All intellectual property rights of the BusinessAnalytiq System and Trend Data are and remain the property of BusinessAnalytiq.
  • Authorized Users acquire no proprietary rights except as expressly permitted by these terms and conditions and the license agreement

 

No Notice of Updates

  • BusinessAnalytiq reserves the right to modify or change these terms and conditions from time to time without notice.
  • The latest version will be available on BusinessAnalytiq website.
  • Your election to continue use of System and Trend Data, after the date of posting of these modifications to the terms and conditions, constitutes acceptance of those modifications.

 

Logo Use Authorization

  • The Customer hereby grants permission to BusinessAnalytiq to feature the name and the logo of Customer’s company/institution on BusinessAnalytiq website and marketing materials, solely for the purpose of identifying company/institution as a BusinessAnalytiq Customer.
  • Private information from the Customer (e.g. name, function, department, address) will not be disclosed.

 

Confidentiality

  • The parties agree to keep confidential all information disclosed by one party to the other party that is reasonably understood to be confidential

 

Dispute resolution

  • Any dispute, controversy or claim arising out of or relating to this contract, including any question regarding its existence, validity or termination, shall be resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC) for the time being in force, which rules are deemed to be incorporated by reference in this clause

 

License Terms

 

Authorized Users with a Single User license can

  • Use the Product for internal business purposes
  • The Trend Data can be shared internally with co-workers & colleagues but not third parties
  • Can create content and analysis based on the Trend Data for internal use within the group

 

Authorized Users with a Partner license can

  • Share Trend Data with third parties
  • Integrate the Trend Data into their own products/services
  • Use the Trend Data without any reference to the source of the Trend Data
  • I reserve the right to discontinue access to the System or Trend Data to any Authorized User at any time with or without cause.

‘Non-personal data’ (NPD) is information that is in no way personally identifiable.

We Collect Your PD in the Following Ways:

Automatic Information

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BUSINESS ANALYTIQ PTE LTD OR ITS SUPPLIERS BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL, INDIRECT, OR EXEMPLARY DAMAGES WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATING TO THIS AGREEMENT OR USER’S USE OF OR INABILITY TO USE THE PRODUCTS, SERVICES AND INFORMATION, OR THE PROVISION OR FAILURE TO PROVIDE SUPPORT SERVICES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF CONFIDENTIAL OR OTHER INFORMATION, BUSINESS INTERRUPTION, PERSONAL INJURY, LOSS OF PRIVACY, FAILURE TO MEET ANY DUTY (INCLUDING OF GOOD FAITH OR REASONABLE CARE), NEGLIGENCE, COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR ANY OTHER CLAIM FOR PECUNIARY OR OTHER LOSS WHATSOEVER, OR FOR ANY CLAIM OR DEMAND AGAINST USER BY ANY OTHER PARTY, EVEN IF BUSINESS ANALYTIQ PTE LTD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

NOTWITHSTANDING ANY DAMAGES USER MAY INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED ABOVE AND ALL DIRECT OR GENERAL DAMAGES), THE ENTIRE LIABILITY OF BUSINESS ANALYTIQ PTE LTD AND ANY OF ITS SUPPLIERS UNDER ANY PROVISION OF THIS AGREEMENT AND YOUR EXCLUSIVE REMEDY FOR ALL OF THE FOREGOING SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID FOR THE PRODUCTS, SERVICES AND INFORMATION OR U.S. $1. THE FOREGOING LIMITATIONS, EXCLUSIONS, AND DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.

If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions of this Agreement will remain in effect. BUSINESS ANALYTIQ PTE LTD has the right to modify these terms and conditions at any time.
